losTransAm Trucking has reached a class action settlement worth $3.75 million to resolve allegations of noncompliance with the Fair Labor Standards Act (FLSA).
This settlement focuses on claims from drivers who claim that the company failed to pay them proper wages as required by federal law.
The massive lawsuit was filed by drivers who attended orientation sessions organized by the company in Rockwall, Texas, or Tampa, Florida, during the period between October 2020 and March 2021.
TransAm Trucking Agrees to Pay $3.75m in Driver Lawsuits
The plaintiffs in this class action lawsuit have accused TransAm Trucking of failing to adequately compensate drivers, violating both state and federal wage laws.
According to the allegations, the company failed to pay truck drivers for time spent in orientation and training, forcing them to work for several days without compensation.
These types of practices, if true, would represent a direct violation of the rules established by the FLSA, which requires employers to pay their workers for all time worked.
TransAm Trucking Did Not Admit Any Illegal Acts but Will Still Pay
TransAm Trucking, headquartered in Kansas, is a company that operates in various regions of the United States, including the Midwest, Mid-South, Northeast and Southeast.
Despite the accusations, the company did not admit any wrongdoing. However, it decided to settle to avoid a lengthy legal process, agreeing to pay a total of $3.75 million to resolve the claims brought in the class action lawsuit.
Some Will Receive a Single Payment, but Must Qualify
Under the terms of the settlement, class members who participated in driver orientation sessions hosted by TransAm Trucking will be eligible to receive cash payments. The exact amount each class member will receive will depend on their individual experiences and the number of valid claims submitted.
Specifically, those who attended the orientations will be eligible to receive a prorated portion of a $125,000 settlement fund. Although payments are estimated to be at least $35, some members may receive larger amounts, depending on the total number of claims submitted and approved.
The agreement sets out several key dates that class members should keep in mind. The deadline to exclude and object to the settlement is August 23, 2024. This date is crucial for those class members who wish to exclude themselves from the settlement or who have objections to the terms of the settlement.
On the other hand, the final approval hearing of the agreement is scheduled for October 25, 2024. During this hearing, it will be determined whether the agreement reached is fair, reasonable and adequate for the members of the class.
How to File a Claim to Become a Plaintiff
In order to receive settlement benefits, class members must submit a valid claim form by August 23, 2024. This action is essential for members to be considered eligible to receive payments set forth in the settlement.
Importantly, the exact amount members will receive will depend on the number of valid claims submitted, meaning those who do not submit a claim by the deadline will not be eligible to receive any payment.
